A written temporary restraining order, preliminary or permanent injunction, or stay whose operative terms bar Nikki Lucas from serving or acting as chair, or bar the Brooklyn Democratic Party from recognizing her as chair, qualifies even if it is interim or limited in scope.\n\nA ruling that only voids the party's rule amendments or only decides who holds interim authority does not qualify unless it also invalidates or enjoins Lucas's election or service as chair. A written ruling that declares the Oct. 4, 2026 executive committee vote void or without effect, or that recognizes another person as the lawful chair for the same term, counts as invalidating Lucas's election.
