It must establish a standard for data-center customers with aggregate peak demand of at least 100 megawatts at one site or campus: recovery from the customer of full incremental generation, transmission, or distribution upgrade costs, including after contract termination, plus financial assurances or contributions before upgrades. The Ratepayer Protection Act's PURPA mechanism requiring state regulators and nonregulated utilities to consider this standard qualifies; state adoption is not required. A substantively equivalent mandatory federal standard also qualifies.
