Only Justices who hear the Court's appellate cases count, so a term-limits or staggered-appointment bill qualifies if it would at any time have more than nine Justices hearing the Court's appellate cases; Justices in senior status, or who hear only original-jurisdiction cases, do not count. Legislation that changes only the Court's jurisdiction, procedures, ethics rules or term limits, adds seats to lower courts, or proposes a constitutional amendment fixing the Court's size does NOT qualify.\n\nThe measure must pass the full House by any means, including voice vote, unanimous consent, suspension of the rules, a special rule or a discharge petition.
